JUDGMENT 1. The sole appellant has challenged the judgment of conviction dated 04.06.1994 under section 302 r/w 201 IPC and order of sentence dated 09.06.1994 passed in Sessions Case No. 93 of 1988/42 of 1991. 2. Mr. A. K. Kashyap, the learned Senior counsel for the appellant, on instructions from the assisting counsel, submits that inspite of efforts taken by the learned assisting counsel no one from the family of the appellant has turned up. 3. Mr. Azeemuddin, the learned APP submits that a report dated 02.03.2019 has been received from Officer Incharge, Lalmatia Police Station in which it is stated that the sole appellant has died in the year, 2015. Along with the report dated 02.03.2019, a copy of the death certificate which records date of death of the appellant as 23.10.2015 has been produced. 4. The report dated 02.03.2019 indicates that during enquiry the Officer Incharge has enquired about appellant from his family members. 5. There is no application for substitution of the appellant filed by his legal heir/successor. 6. In view of the aforesaid facts, Criminal Appeal (DB) No. 306 of 1994 stands abated. 7. Ordered accordingly. 8. Bail-Bonds furnished by the appellant stand discharged.
