JUDGMENT Shree Chandrashekhar, J. - The petitioner seeks quashing of the First Information Report vide Hiranpur P.S. Case No.05 of 2016, corresponding to G.R. No.38 of 2016 which has been registered for the offence punishable under sections 409, 420 r/w 34 I.P.C. 2. Mrs. Neetu Singh, the learned counsel for the petitioner submits that the petitioner who at the relevant time was posted as Block Programme Officer, Hiranpur has no role in withdrawal of the money and the official records would disclose that it was co-accused Surendra Narayan Saha who is the person responsible for excess withdrawal of the money and consequent misappropriation. 3. Mr. Rakesh Kumar, the learned A.P.P appears for the State of Jharkhand. 4. Contention raised on behalf of the petitioner is that merely because he was posted at Hiranpur Block and associated with preparation of muster roll, without assigning any specific role in the occurrence he cannot be made an accused. 5. Stating that now charge-sheet has been submitted in the case and the petitioner has been sent up for trial, the learned counsel for the petitioner seeks permission to withdraw this petition with liberty to the petitioner to raise the aforesaid plea and any other plea which may be available to him at the time of framing of the charge. 6. In view of the limited prayer made on behalf of the petitioner, without commenting upon the merits of the matter, Cr. M.P. No.2358 of 2016 stands dismissed as withdrawn with liberty to the petitioner, as prayed for.
