ORDER 1. Leave Granted. 2. An inquiry was conducted by the State Level Scrutiny Committee to find out whether the First Respondent belonged to 'Malai Pandaram' community which is a Scheduled Tribe. The First Respondent was appointed in the post reserved for Scheduled Tribes. Pursuant to the report submitted by the State Level Scrutiny Committee, the service of the First Respondent was terminated by an order dated 08.11.2013. 3. The First Respondent attained the age of superannuation on 30.7.2014. The First Respondent filed a writ petition challenging the order of termination dated 8.11.2013 in the High Court which was allowed by the High Court by the impugned judgment. The High Court observed that the procedure prescribed in the judgment of this Court in Kumari Madhuri Patil vs. Additional Commissioner reported in , (1994) 6 SCC 241 was not followed by the Scrutiny Committee before submitting its report on the basis of which the order of termination of the service of the First Respondent was passed. The High Court directed the State Level Scrutiny Committee to re-examine the matter by following the procedure prescribed by this Court in Kumari Madhuri Patil (supra). We do not see any infirmity in the impugned judgment and we are not inclined to interfere. 4. While setting aside the order dated 08.11.2013 by which the service of the First Respondent was terminated, the High Court directed payment of back wages also. We see nothing wrong in order of termination of the service of the First Respondent being set aside and the matter being remanded to the Scrutiny Committee for a fresh consideration. However, we are not in agreement with the direction given by the High Court to the Appellant to pay back wages to the Respondent. The payment of back wages shall be dependent on the outcome of the report of the Scrutiny Committee and the consequential action of the Appellant-Bank on the basis of the report. 5. Ms. V. Mohana, learned Senior Counsel appearing for First Respondent submits that he may be permitted to make a representation to the Appellant for release of certain monetary benefits to which he is entitled to. The First Respondent is granted permission to make a representation to the Appellant-Bank which shall be considered by the Appellant-Bank. 6. The appeal is, accordingly, disposed of. Pending application(s), if any, stand disposed of.
