ORDER 1. Though, undoubtedly there is some prolonged delay on the part of the applicant in filing the undertaking, the same having now been filed, we are inclined to condone the delay. 2. Learned counsel for the appellant states that since the undertaking had not been furnished, they had not encashed the cheque which has become time barred. Valid cheque be issued by the respondents within two weeks from today. 3. Miscellaneous Applications are accordingly disposed of.
