JUDGMENT : Admit. 2. Lower Court Record has already been called in Cr. Appeal (S.J.) 157 of 2019 and other analogous appeals. 3. List this case under the heading “For Hearing” as per seriatim along with Cr. Appeal (S.J.) 157 of 2019. I.A. No. 2226 of 2019 4. Heard learned counsel for the appellant and learned counsel for the C.B.I. 5. It is submitted on behalf of the appellant that the appellant has been held guilty and sentenced rigorous imprisonment for one year with fine of Rs.5,000/- for the offence under Section 420 as well as rigorous imprisonment for one year with fine of Rs. 5,000/- each under Section 468 of the Indian Penal Code and rigorous imprisonment for one year with fine of Rs. 5,000/- each under section 471 of the Indian Penal Code as well as rigorous imprisonment for one year with fine of Rs. 5,000/- each under Section 120 B read with Sections 420, 468 and 471of the Indian Penal Code and Sections 13 (2), 13 (1) (d) of the Prevention of Corruption Act, 1988. She further submits that the Court below has granted provisional bail to this appellant by terms of order dated 30.01.2019 for a period of one month, which was extended for further period of fifteen days by order dated 01st March, 2019. She prayed for confirmation of the provisional bail granted to this appellant by the Court below. 6. Also heard learned counsel for the C.B.I. 7. The provisional bail granted to this appellant- Aftab Alam by the Court below on 30.01.2019, and also extended by order dated 01st March, 2019 are hereby, confirmed subject to deposit of fifty per cent of the fine amount imposed upon appellant within a period of two months from today without being prejudiced to his right. In case, fine amount is not deposited within two months from today then appellant shall surrender before the court below after two months for serving out the sentence imposed upon the appellant. 8. Thus, I.A. No.2226 of 2019 stands allowed. 9. Let a copy of this order be transmitted to the Court concerned through FAX to the Court concerned at the cost deposited by the appellants.
