JUDGMENT Sujit Narayan Prasad, J. - This matter has been listed under the heading for Orders (with defect) since the defect has not been removed in spite of the order passed by the Lawazima Board on 17.05.2018 and 02.11.2018. 2 . Considering the nature of defect, the same is ignored. 3 . The matter has been taken up for hearing with consent of the parties. 4 . The relief sought for in this writ petition is for quashing of the notice dated 10.09.2016 issued by the respondent No.2 whereby and whereunder by exercising the power under Section 83-A of the Jharkhand State Housing Board, 2001 the petitioner has been directed to vacate the premises and handover the same to the Housing Board, failing which the respondents will take steps under Section 59 of the Act for vacating possession over the premises in question. 5 . Dr. Ashok Kumar Singh, learned counsel appearing for the Jharkhand State Housing Board has submitted that the similar matter fell for consideration before this Court in W.P.(C) No.3796 of 2018 along with other 12 analogous cases in which the order has been passed directing the parties to initiate a proceeding by resorting the provision of Section 59-B of the Jharkhand State Housing Board, 2000, therefore, he has submitted to dispose of the writ petition in terms of the order passed in the aforesaid cases. 6 . Having heard the learned counsel for the parties and looking to the pleadings made in the writ petition as also the nature of prayer, this writ petition is disposed of directing the authorities of the Jharkhand State Housing Board to initiate a proceeding, if they intend to evict the petitioner from the premises, by resorting the provision of Section 59-B of the Act, 2000 and take decision in accordance with law in this regard. 7 . In view thereof, this writ petition is disposed of. 8 . Needless to say that the Managing Director of the Board will monitor the issue.
