JUDGMENT 1. This writ petition has been filed by the petitioner seeking direction to the respondents to grant appointment to the petitioner on the post of Teacher Gr.-III, Level-II with consequential benefits pursuant to the advertisement dated 24.02.2012. 2. It is submitted by learned counsel for the petitioner that the issue raised is covered by judgment in Mukesh Kumar Tailor v. State of Rajasthan : S.B.C.W.P. No. 750/2017, decided on 09.02.2017, which in turn had relied on judgment in Manju Choudhary & Ors. v. State of Rajasthan & Ors. : D.B. Civil Special Appeal (Writ) No. 35/2014. 3. A reply to the writ petition has been filed by the respondents, wherein, it is submitted that the posts of ST (Male) have already been filled and last cut off was 162.22 marks and as petitioner has secured 154.15 marks, he is not entitled to any relief. 4. In the case of Mukesh Kumar Tailor/Manju Choudhary (supra) the directions were given in case the posts were vacant. 5. As a specific submission has been made regarding no post being vacant and the petitioner having obtained less marks than the cut off, no case for grant of direction, as given in the case of Mukesh Kumar Tailor/Manju Choudhary (supra), is made out. There is no substance in the writ petition and the same is, therefore, dismissed.
