JUDGMENT : MOHAMMAD YAQOOB MIR, J. 1. In compliance to various directions issued from time to time, the Disrict Monitoring Committee which was constituted is continuously conducted local inspections. 2. Construction of soak pits by various shop owners, individual households, industries, institutions, private hotels, petrol pumps, car washing, toiletries etc. according to the report of District Monitoring Committee have been completed, PHE department has to take follow action regularly. 3. Deputy Commissioner in the affidavit as referred to in the order dated 18.02.2019 has stated that continuous monitoring through District Monitoring Committee shall be carried out on regular basis so as to avoid indiscriminate discharge of solid and liquid waste into Umran river. 4. Meghalaya State Pollution Control Board (MSPCB) is regularly taking water samples and on analysis, reports have been submitted from time to time. Now as per the last affidavit filed by the In-charge Member Secretary of MSPCB it has been made clear that in the monitoring process, MSPCB is deputing its official regularly to collect water samples of the water from the inlet and outlet drains of BPCL petrol pump at Umran Ri Bhoi District from the upstream and downstream of Umran river and from the two locations of the treated water at Nongpoh. 5. The analysis report as being received reveal that at locations No.1, 4 and 5, water quality conforms to the standard for drinking water whereas at locations No.2 and 3 i.e. upstream of Umran river and downstream flowing behind the boundary of BPCL petrol pump, turbidity of the water is found to be above the limits of Indian standard for drinking water. However, in the conclusion it is stated as under:- "It was observed that the turbidity level has reduced indicating an improvement in River Water Quality. Further, the river water is never used for drinking purpose directly and the same is treated before supplying to the public." 6. It is further stated that MSPCB has suggested the measures to reduce turbidity level in Umran River to the Government vide its letter dated 05.03.2019.

These are as under:- (i) By prohibiting the use of drains and streams for dumping of solid waste and construction waste; (ii) By prohibiting the use of drains and streams for direct discharge of liquid waste; (iii) By preventing of surface runoff water; and (iv) The water quality of Umran River (upstream and downstream) is not recommended for direct use for drinking purposes unless treated and disinfected by an organized water supply system and ensure the adequate operation of water treatment with high raw water turbidity. 7. Continuous collection of samples by MSPCB and analysis reports thereof, suggests that water quality has improved what is further required is constant monitoring from time to time by the District Monitoring Committee as is in place. The Deputy Commissioner concerned has reported that the District Monitoring Committee is extra vigilant and is monitoring it. 8. In our view continuation of the proceedings of this PIL are not required therefore we dispose it of with the following directions:- (i) District Monitoring Committee which is in place will continue to monitor as it has been monitoring. While monitoring will keep in view the suggestions of MSPCB as quoted above; and (ii) MSPCB will also continue to collect samples for monitoring the quality of water. 9. We make it clear that if at any point of time any slackness on the part of District Monitoring Committee or MSPCB, any person notices the same, shall be at liberty to bring it to the notice of the Court for appropriate action. 10. Disposed of as above.
