ORDER 1. Present petition is arising out of the order dated 25.1.2019 by which the trial Court has rejected the prayer made by the petitioners for consolidation of two suits. 2. The facts of the case reveal that the petitioners have filed a suit for declaration, permanent injunction and cancellation of sale deed dated 30.9.2014 in respect of suit land bearing survey No. 95/1 and 96, area 1.16 hectare, total area 3.58 hectare situated at village Dhobi, Pachore, Tahsil Mohan Badodia, Distt. Shajapur. 3. The aforesaid suit as stated in the writ petition is pending before the Court of III Civil Judge, Class-I, Shajapur, i.e., Civil Suit No. 138-A/14. The respondents No. 3 and 4 have also filed a suit against the petitioners in respect of possession of the same suit land and the suit has been registered as C. S. No. 19-A/2016 and the same is pending before III Civil Judge, Class-I, Shajapur. 4. The petitioners, as the subject-matter of the suit was in respect of the same land, have filed an application for consolidation of suits and the same has been rejected. 5. In spite of service of notice to all respondents, there is no appearance on behalf of the respondents. 6. On 20.6.2019, 15.10.2019 and 7.11.2019, there was no appearance in spite of service of notice. 7. This Court has carefully gone through the order passed by the Civil Judge, Class-I, Shajapur. Undisputedly, the dispute relates to the same land between the same parties and, therefore, in order to avoid multiplicity of the judicial proceedings, this Court is of the opinion that the application ought to have been allowed keeping in view the peculiar facts and circumstances of the case. 8. Resultantly, the application Annexure P-8 is allowed. The impugned order passed by the learned Single Judge is hereby quashed. The trial Court, after consolidating the suit, shall proceed ahead in accordance with law. 9. With the aforesaid, present petition stands disposed of.
