JUDGMENT : Vivek Chaudhary, J. Heard learned counsel for the applicants and the learned A.G.A. for the State and perused the record. 2. The instant application has been filed seeking quashing of the entire proceeding of Criminal Case No. 17019 of 2017, arising out of Case Crime No. 63 of 2016, under sections 498-A,308,323,504,506 I.P.C. and Section 3/4 of Dowry Prohibition Act, Police Station-Thakurganj, District-Lucknow, pending in the court of Special Additional Chief Judicial Magistrate, C.B.I.(AP), Lucknow and impugned summoning order dated 23-05-2017 as well as impugned charge-sheet dated 18-12-2016, contained in Annexure Nos. 1 & 2 to the application. 3. Learned counsel for the applicants submit that both the parties have amicably compromised their dispute. The compromise which has taken place between the parties is also filed before this Court as Annexure No. 4 to the application. 4. Whether the parties have, in fact, compromised the matter or not, can best be ascertained by the Court below as such compromise has to be duly verified in presence of the parties concerned before the Court. 5. Accordingly, this application is disposed of with a direction to the court concerned that if any such compromise is filed before it, it shall issue notices to all the signatories to the compromise requiring their personal presence and, thereafter, proceed to verify the compromise. If the aforesaid compromise is verified, a report to that effect shall be prepared by the court and the compromise will be made part of the record. The court in that scenario will allow the parties to obtain certified copy of the report as well as compromise and it will be open to the applicants to approach this Court again for quashing of the proceedings. 6. Till verification of compromise between the parties by the court concerned, no coercive action shall be taken against the applicant in the aforesaid case.
