JUDGMENT : Sandeep Sharma, J. Sequel to order dated 12.6.2019, SI Jai Dev Sharma, Police Station Sunni, District Shimla, H.P., has come present along with the record. Mr. Kunal Thakur, learned Deputy Advocate General, has also placed on record status report, prepared on the basis of the investigation carried out by the Investigating agency. 2. Learned Deputy Advocate General, on the instructions of Investigating Officer, states that 11 witnesses have been already examined, whereas remaining witnesses are scheduled to be examined on 1st/ 2nd August, 2019 and 16th and 17th August, 2019. 3. In view of the aforesaid statement having been made by learned Deputy Advocate General, Mr. Satyen Vaidya, learned Senior Counsel representing the bail petitioner, seeks permission to withdraw the present petition at this stage with liberty to file afresh at appropriate stage, in accordance with law, if required and desired. 4. Consequently, in view of the above, the present petition is dismissed as withdrawn with liberty reserved to the petitioner to file afresh at appropriate stage, if required and desired, in accordance with law. 5. However, having taken note of the fact that bail petitioner is behind the bars since 27th December, 2014 and all material prosecution witnesses have been examined coupled with the fact that remaining witnesses are scheduled to be examined on the dates mentioned hereinabove, this Court hopes and trust that learned trial Court below shall make all out efforts to conclude the trial expeditiously, preferably on or before 31st October, 2019. Otherwise also, it has been already made aware to all Courts on the administrative side that jail appeals as well as cases of under trial are required to be heard and decided on priority basis. 6. Registry is directed to apprise the learned Court below with regard to passing of instant order, to enable it to do the needful within stipulated time.
