Having heard learned counsel for the parties and on perusal of the record of the case, we consider it just and proper and in the interest of justice to grant one more indulgence to the appellant to lead the evidence in support of his case before the trial court subject to paying a cost of Rs.5,000/- to the respondents. 4. Let the cost be paid to the respondents within one month. 5. The trial court shall conclude the hearing within three months from the date of parties appearance. The parties to appear before the trial court on 02.04.2019 to enable it to dispose of the matter within three months thereafter. 6. The civil appeal is allowed; impugned order is set aside. 7. Pending applications, if any, stand disposed of.
