JUDGMENT Ramendra Jain, J. (Oral) - Through this petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to the petitioner in a case arising from FIR No.61 dated 03.07.2018 registered under Section 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (Section 29 of the NDPS Act added subsequently) at Police Station Harike, District Tarn Taran, Punjab. 2. According to the prosecution, 5430 tablets of different description, 600 injections and 59 vials containing narcotic substance were recovered from the matrimonial house of the petitioner in her presence. 3. Learned counsel inter alia contends that petitioner has falsely been implicated in the aforesaid FIR. She is innocent. Alleged recovery has been effected from the matrimonial house of the petitioner. Her father-in-law is a licenced chemist. She is in custody since 27.02.2019. Conclusion of trial may take a sufficient long time. No useful purpose would be served by detaining the petitioner in jail any more. 4. On the other hand, learned State counsel vehemently opposed the grant of regular bail to the petitioner. 5. Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner is ordered to be released on bail during pendency of trial, on her furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
