Judgment Mr. Ajay Tewari, J. (Oral) This petition has been filed under Section 438 Cr.P.C for grant of anticipatory bail to the petitioners in case FIR No. 33 dated 1.3.2019 registered under Sections 306/506 IPC at PS Canal Colony, Bathinda,Punjab. 2. As per the FIR, the son of the complainant has fallen sick on 20.2.2019 and was admitted in various hospital and ultimately died on 28.2.2019. After his death the complainant came to know that actually his son had a love affair with the daughter of the petitioners and they were objecting to the same, therefore, his son consumed some poisonous substance and died. 3. In my opinion, these allegations do no justify custodial interrogation of the petitioners. Without commenting on the merits of the case and keeping in view the facts and circumstances of the present case, I do not deem it appropriate to deny the petitioners the concession of anticipatory bail. 4. Resultantly, the petition is allowed. The petitioners are directed to appear before the investigating officer on 30.3.2019 and on any other date as and when their presence is required. In the event of arrest they will be released on bail by the Investigating Officer subject to the conditions envisaged under Section 438 (2) Cr.P.C. 5. Since the main case has been decided, the pending criminal miscellaneous application, if any, also stands disposed of.
