JUDGMENT Vishnu Pratap Singh Chauhan, J. - Heard on this first application for bail under Section 439 of Cr.P.C. filed on behalf of the applicant. The applicant is in jail in connection with Crime No.241/2020 registered at Police Station Dehat, District Chhindwara for commission of offence punishable under Sections 305 of the IPC. 2. The case of the prosecution against the applicant, in short, is that one Khushal theft Rs.30,000/- from the house of the applicant and gave the money to deceased namely Anshul @ Abhishek. The applicant came at the house of Anshul @ Abhishek for enquiring that fact and started harassing and beating him. The applicant dragged the deceased for taking him to the Police Station, but took him on the road and again started beating him, thereafter, the applicant left him there. Thereafter, deceased Anshul @ Abhishek consumed some poisonous substance. On next day, he succumbed to that poison. 3. Learned counsel for the applicant submits that the applicant only enquired about theft money. He neither beat the deceased nor harassed him. Deceased committed suicide but there is no evidence against the applicant regarding instigation. He is in jail in Chhindwara and many inmates are found covid-19 positive there; therefore, it has been prayed that the applicant may be enlarged on bail. 4. Learned counsel for the objector, on the other hand, opposes the application for bail and submits that the applicant came inside the house of the deceased and deceased was minor at that time. He was 15-16 years old. The applicant beat him and threatened him for lodging report against him. In such situation, deceased left with no option but to commit suicide; therefore, prayed for dismissal of this application. 5. Learned Panel Lawyer for the State also supported the arguments advanced by counsel for the objector. 6. Heard learned counsel for the parties and perused the documents. 7. Keeping in view the facts and circumstances of the case, particularly, looking to the act of the applicant, this Court is not inclined to enlarge the applicant on bail. 8. Consequently, this application for bail under Section 439 of the Code of Criminal Procedure filed on behalf of applicant-Ankur Mahore deserves to be and is accordingly dismissed.
