JUDGMENT Rajeev Kumar Dubey, J. - This is second application under Section 439 Cr.P.C for grant of bail. Applicant Brijendra Kumar was arrested on 14/02/2019 in connection with Crime No.10/2019 registered at Police Station Langadol, Distt. Singrauli (M.P.) for the offences punishable under Sections 304-B, 498, 34 of the IPC and Section 4 of the Dowry Prohibition Act. 2. The earlier bail application filed by the applicant was dismissed as withdrawn by this Court vide order dated 23/07/2019 passed in M.Cr.C.No.17330/2019. 3. As per the prosecution case, on 13/01/2019 deceased Phulkumari, wife of applicant Brijendra committed suicide by hanging herself. It is alleged that the applicant Brijendra Kumar and co-accused Keshmati mother-in-law, Devidayal father-in-law and Rajendra brother-in-law of the deceased used to harass her and demanded dowry and also assaulted her, due to which she committed suicide within four years of her marriage 4. Learned counsel for the applicant submits that the applicant is innocent and has falsely been implicated in the offence. The allegations regarding demand of dowry are general in nature. The applicant has been in custody since 14/02/2019. The charge-sheet has been filed and conclusion of trial will take time, hence prayed for release of the applicant on bail. 5. On the other hand, learned counsel for the State opposed the prayer a n d submitted that the applicant harassed deceased Phulkumari and demanded dowry, due to which she committed suicide. So, the applicant should not be released on bail. 6. Looking to the facts and circumstances of the case and and the fact that it is alleged that applicant who was the husband of the deceased used to harass her and demanded dowry, due to which she committed suicide within four years of her marriage, this Court is not inclined to grant bail to the applicant. 7. Accordingly, M.Cr.C. is dismissed.
