JUDGMENT ORDER 1. Hearing has been conducted through Video Conferencing. CM APPL. 19816/2020 2. Exemption allowed, subject to all just exceptions. 3. Application stands disposed of. W.P. (C) 5505/2020 & CM APPL. 19815/2020 4. Petitioner has joined the Air India Limited on 16.10.2007 as a Trainee Pilot and after promotions, is currently serving as a Commander. 5. Challenge in the writ petition is to the letter dated 13.08.2020 whereby the Respondent has rejected the request of the Petitioner for withdrawal of his resignation, retrospectively. Learned counsel draws the attention of the Court to a letter dated 19.03.2020 whereby request of the Petitioner for withdrawal of the resignation was accepted and submits that the impugned action is contrary to the earlier stand of the Respondent and is impermissible in law. 6. Issue notice. 7. Mr. Dhruv learned counsel enters appearance on behalf of the Respondent and submits that the present petition be listed on 25.08.2020 when a batch of similar petitions is coming up before this Court. 8. Having heard learned counsels for the parties, this Court is of the prima facie view that in law, once the withdrawal of resignation is accepted, the decision cannot be recalled. 9. In view of the above, the operation of the letter dated 13.08.2020 shall remain stayed till the next date of hearing. 10. List on 25 th August, 2020.
