JUDGMENT Anjuli Palo, J. - The appellant is in custody since 22.7.2020 in connection with Crime No.195/2020 registered at P.S. Rampayli, District Balaghat for the offences punisable under Sections 366, 376, 370, 323, 506, 34 of the Indian Penal Code and Section 3(1)(w) (2), 3(2)(v), 3(2) (5ka) of the SC/ST (Prevention of Atrocities) Act. 2. As per prosecution, co-accused Hitesh Bisen along with Dhanraj Patle developed intimacy with the prosecutrix thereafter committed sexual intercourse with her for about two years. Thereafter, on the pretext of performing marriage with co-accused Hitesh at Nagpur, they took her to Tikamgarh where they sold her to present applicant without her free consent. 3. Learned counsel for the applicant submits that the appellant has been falsely implicated in this case. It is submitted that the applicant has performed marriage with the prosecutrix. In support of this contention, some photographs of the marriage of the applicant and prosecutrix have been filed as Annexure A-2 and Panchnama and certificate of marriage issued by Gram Panchayat Luharguvan, District Tikamgarh. It is submitted that the prosecutrix performed marriage with the applicant with her free consent and she was happy during the marriage ceremony, which is apparent from the photographs which have been filed. The appellant is in custody and trial would take considerable time due to situation created by Covid-19 pandemic, therefore, the appellant may be enlarged on bail. 4. Learned Panel Lawyer has strongly opposed the prayer for bail. 5. Considering the overall facts and circumstances of the case and the fact that the prosecutrix has performed marriage with the appellant, I deem it appropriate to enlarge the appellant on bail, therefore, without commenting upon the merit of the case, the appeal is allowed. 6. It is directed that appellant Raheesh Ghosh shall be released on bail on his furnishing a personal bond in a sum of Rs.50,000/- (Rupees Fifty Thousand Only) with one surety in the like amount to the satisfaction of the trial Court concerned for his appearance before the said Court on all such dates as may be fixed in this regard during the pendency of trial. 7. It is further directed that the appellant shall comply with the provisions of Section 437(3) of the Cr.P.C. 8. Disposed of accordingly.
