JUDGMENT Shailendra Shukla, J. - Heard. Perused the case diary. 2. This is fourth application under Section 439 of Cr.P.C. for grant of bail. Applicant - Ajay S/o Nirbhay Singh is implicated in Crime No.354/2019 registered at Police Station - Neelganga, District Ujjain for the offence punishable under Sections 323, 294, 147, 148, 149 and 307 of IPC along with Section 25 of the Arms Act and he is in custody since 28.06.2019. 3. Learned counsel for the applicant submits that applicant had been granted temporary bail for a period of 60 days vide order dated 05.08.2020 passed in MCRC No.22165/2020 and applicant has duly surrendered before the Trial Court and the Covid-19 Pandemic situation remains unchanged and seeks temporary bail for a period of 60 days. 4. Learned Public Prosecutor for the State was also heard. 5. It is quite apparent that Covid-19 Pandemic situation has remain unchanged and the Trial Courts are not functioning as far as matters concerning collection of evidence is concerned. It would be in the fitness of things to grant temporary bail to the applicant for a period of 60 days. Without commenting upon the merits of the case, this bail application is allowed and it is directed that applicant - Ajay shall be released on bail temporarily for a period of 60 (Sixty) days subject to his furnishing a bail bond of Rs.50,000/- (Rupees Fifty thousand only) with one solvent surety in the like amount to the satisfaction of the Trial Court/Committal Court and an undertaking that he will surrender before the concerned Court immediately after expiry of 60th day from the date of his release. It is made clear that applicant on being on released on bail, shall not indulge in any criminal activities and shall not threaten or influence the witnesses. 6. A copy of this order be sent to the Court concerned for compliance. 7. M.Cr.C. No.39226/2020 is allowed and stands disposed of Certified copy as per rules.
