JUDGMENT Anjuli Palo, J. - These Criminal Appeals have been filed on behalf of the appellants under Section 14-A (2) of the SC/ST (Prevention of Atrocities) Act, 1989 for grant of regular bail. 2. The appellants are in custody since 21.08.2020 & 07.07.2020 respectively in connection with Crime No.252/2020 registered at P.S. Bargawan, District Singrauli for the offences punishable under Sections 294, 353, 332, 427, 506 & 34 of the Indian Penal Code and Sections 3(2)(va) & 3(1)(r)(s) of the SC/ST (Prevention of Atrocities) Act. 3. Learned counsel for the appellants submits that the appellants are innocent and have been falsely implicated in this case by taking advantage of provision of the SC/ST (Prevention of Atrocities) Act by the complainant. The appellants are in custody and trial would take considerable time due to situation created by Covid-19 pandemic, therefore, the appellants may be enlarged on bail. 4. Learned Panel Lawyer for the State as well as learned counsel for the objector have vehemently opposed the contentions of the appellants. 5. Heard learned counsel for the parties. 6. From perusal of the record, it is clear that previously Dehati Nalisi was registered under Sections 353, 332, 427 & 294 of the I.P.C. and thereafter, during the investigation provisions of Sections 3(2)(va) & 3(1)(r) (s) of the SC/ST (Prevention of Atrocities) Act have been added. As per prosecution case, no one received grievous injuries. Charge-sheet has been filed against the accused persons. 7. Considering the overall facts and circumstances of the case and taking into account that due t o spread of Covid-19 pandemic, trial would take considerable time to conclude. Hence, I am of the opinion that it would be appropriate to release the appellants on bail, therefore, without commenting on the merits of the case, these appeals are allowed. 8. It is directed that appellants namely Chandan Singh, Kundan Singh & Devendra Pratap Singh shall be released on bail on their furnishing personal bond in a sum of Rs.40,000/- (Rupees Forty Thousand Only) each with one surety each in the like amount to the satisfaction of the trial Court concerned for their appearance before the said Court on all such dates as may be fixed in this regard during the pendency of trial. 9. It is further directed that the appellants shall comply with the provisions of Section 437(3) of the Cr.P.C. 10. Disposed of accordingly.
