JUDGMENT Arvind Singh Sangwan, J. (Oral) - Prayer in this petition is for grant of regular bail to the petitioner under Section 439 of the Code of Criminal Procedure (in short Cr.P.C.) in FIR No.100 dated 19.06.2019, for offence punishable under Sections 325, 307, 427, 323, 341, 506, 148, 149 of the Indian Penal Code, 1860 (in short IPC) (Section 34 IPC stands deleted) registered at Police Station PAU, Ludhiana, District Ludhiana. 2. Counsel for the petitioner has argued that the petitioner was not named in the FIR and is not attributed any role as the allegations are primarily against Bhupinder Singh @ Binder Kumar that he with intention to extort money from the complainant has caused grievous injury on his left forearm resulting into 03 fractures. It is further argued that the similarly situated co-accused of the petitioner namely Gagandeep Singh, Hardeep Singh @ Deepu and Ramandeep Singh, have already been granted the concession of anticipatory/regular bail vide orders dated 18.11.2019, 07.11.2019 and 30.10.2019 passed in CRM-M Nos.40357, 38210 and 45154 of 2019. 3. Counsel for the petitioner has further argued that the petitioner is not involved in any other case and report under Section 173(2) Cr.P.C. stands presented before the trial Court and the conclusion of the trial will take some time. 4. Counsel for the State, on the other hand, has not disputed the factual position but opposed the prayer for bail. 5. Without commenting anything on merits of the case, considering the fact that the report under Section 173(2) Cr.P.C., stands presented before the trial Court; similarly situated co-accused of the petitioner have already been granted the concession of bail by this Court and the conclusion of the trial will take long time, this petition is allowed and the petitioner is directed to be released on bail subject to his furnishing bail/surety bonds to the satisfaction of the trial Court/Illaqa Magistrate/Duty Magistrate. 6. However, it will be open for the prosecution to apply for cancellation of bail of the petitioner, in case he is found involved in any other case or misusing the concession of bail, in any manner.
