JUDGMENT Sudip Ahluwalia, J. (Oral) - Seen the Reply dated 22 nd May, 2019 filed on behalf of the State which includes the list of 08 other FIR cases in which the Petitioner is said to be involved. 2. It transpires that the Petitioner has been acquitted in three of those cases while one of the FIR (No.29 dated 27 th January, 2016) was cancelled, and another FIR (No.68 dated 22 nd July, 2012) was quashed by this Court. Apart from that, the Petitioner is now facing trial in three other cases. 3. In the given circumstances, this Court is not inclined to regard the Petitioner as a hardcore criminal, who ought to be denied the benefit of parole on the bald assertion that there is likelihood of his indulgence in more criminal activities, if so released, or absconding from the arms of law. 4. The Petitioner has admittedly undergone imprisonment well in excess of three years by now. 5. Consequently, the impugned order (Annexure P-l) rejecting the Petitioner's application for parole on the aforesaid grounds, is untenable and is hereby set aside. 6. The Petition is therefore disposed off with a liberty to the Petitioner to apply afresh for his release on parole, on which an appropriate order shall be passed by the Competent Authority within three weeks from the date, the application is submitted.
