JUDGMENT Anil Kshetarpal, J. - CRM No.10773-2020 Allowed as prayed for. MAIN 2. The petitioner prays for grant of bail pending trial in a criminal case arising out from FIR No.433, dated 27.10.2018, registered under Sections 376/506/34 IPC (challan under Sections 376/201/328/384/506 IPC), at Police Station Matlauda, District Panipat. 3. In a nutshell, the case of the prosecution is that the petitioner, who is aged about 27 years, continued to rape her on false promise of subsequently marrying her. 4. The petitioner and the prosecutrix used to work in a Gym at Delhi together. The prosecutrix was living in a PG accommodation. The prosecutrix after leaving the job also claimed to have continued with the relationship with the petitioner. The FIR was got registered by the victim only when she came to know that the petitioner is already married. 5. Hearing of the case was held through video conferencing on account of lock-down. 6. The petitioner is in custody since 18.07.2019. The prosecution has yet to examine large number of witnesses. 7. Without commenting on the merits of the case and keeping in view the fact that the petitioner is in custody since 18.07.2019 and conclusion of the trial is likely to take some time, the petitioner is directed to be released on regular bail subject to furnishing of adequate surety to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, concerned. 8. Accordingly, the petition is allowed with the aforesaid directions.
