JUDGMENT T. Vinod Kumar, J. - The present writ petition is filed to declare the action of the 3rd respondent-Station House Officer, Keshavapatnam Police Station, Karimangar District, in interfering with the personal life and liberty of the petitioners, as being illegal and arbitrary. 2. Heard Sri Mohd. Abdul Raheem, learned counsel for the petitioners and the learned Assistant Government Pleader for Home appearing for the official respondents 1 to 3. 3. The learned Assistant Government Pleader for Home, on written instructions dated 10.01.2020, which is placed on the record of this Court, would submit that one Smt. Kamera Mounika-4th respondent, gave a complaint to the 3rd respondent on 28.11.2019 wherein she alleged that she got married with one Dumpa Naresh, who is the first petitioner herein, and after marriage her husband and in-laws harassed her physically and mentally to bring additional dowry, as such requested to take action. 4. It is submitted by the learned Assistant Government Pleader for Home that on receipt of the above complaint, a GD entry was made and as the matter pertains to matrimonial issue, the first petitioner was called to the police station for attending counseling, upon which he attended the counseling and requested for sometime. Thereafter, the first petitioner instead of approaching the 3rd respondent for further counseling has filed the present writ petition with false and frivolous allegations. 5. The learned Assistant Government Pleader for Home based on the written instructions, further submits that since, the counseling failed, as such a case was registered based on the complaint of 4th respondent in Crime No.2 of 2020 of Keshavapatnam Police Station for the offences punishable under Sections 498-A of the Indian Penal Code, 1860 and Section 4 of the Dowry Prohibition Act on 09.01.2020 wherein the first petitioner is arrayed as accused No.1. It is also submitted that apart from conducing counseling, the respondent police authorities never harassed the petitioners nor interfered in their personal issues except investigating into the crime registered. 6. Having regard to the said submissions that a case is registered in Crime No.2 of 2020 and is under investigation, no further orders need be passed in this writ petition, except observing that the respondent police authorities shall act in accordance with law, with regard to the investigation into the above case. 7. Subject to the above observation, the writ petition is closed.
7. Subject to the above observation, the writ petition is closed. However, there shall be no order as to costs. 8. As a sequel thereto, Miscellaneous Applications, if any, pending in this Writ Petition shall stand closed.
