ORDER [ Hearing held through video-conferencing ] 1. The petitioner has filed the present petition, inter alia, seeking anticipatory bail in connection with FIR No.0403/2020, under Sections 498A/304B/34 of the IPC, registered with PS Aman Vihar. 2. The said FIR was registered in view of the information received on 13.08.2020 that the deceased had committed suicide. Subsequently, the statement of the father of the deceased was recorded. On receipt of the information, the investigation was entrusted to ASI Bhagwan Shai, who reached the place of the incident. He found the body of the deceased along with one chunni tied with a bed sheet and one scissor was lying on the bed of the ground floor of the said house. Crime team was called at the spot. 3. The post-mortem of the deceased was conducted and it is stated that the death was due to ante mortem hanging. The husband of the deceased was arrested on 26.08.2020. The concerned police official had also stated that the parents of the deceased were present at the spot, when he reached the place of incident. The statement of the father of the deceased was recorded and he had stated that his daughter was married to one Jitender on 02.05.2014. He had alleged that she was being tortured and beaten by her husband and his family members. He also stated that she had come to reside with him for an extended period on two occasions. She had gone back to her matrimonial house to reside with her husband after the intervention of Panch. He also alleged that the father-in-law of the deceased had told him that he had killed his daughter. 4. It is seen that there are no specific allegations had been made against the petitioner and bulk of the allegations are focussed on the husband of the deceased and her father-in-law. The husband of the deceased was arrested on 26.08.2020 and is in judicial custody since. 5. The statements of the cousin sister and the mother of the deceased were also recorded and none of them made any specific allegations against the petitioner. The investigation is not yet complete. 6. In the given circumstances, this Court considers it apposite to grant anticipatory bail to the petitioner on her furnishing a Personal Bond in the sum of Rs.10,000/- and one surety of an equivalent amount to the satisfaction of the concerned IO. This is also subject to the further following conditions: (a) The petitioner shall appear before the concerned IO on 30.09.2020 at 10:30 AM and all further dates as required by the IO; (b) The petitioner shall not leave the National Capital Territory of Delhi, and; (c) The petitioner shall not try and influence or contact the parents of the deceased. 7. It is clarified that the present order would inure to the benefit of the petitioner till a charge-sheet is filed. 8. The petition is disposed of with the aforesaid directions.
