JUDGMENT 1. By filing this petition under Section 438 of the CrPC , petitioner Shona Ullah Sheikh has sought for prearrest bail in connection with Dhubri P.S. Case No.1896/2019, under Sections 498(A)/494/511/406/420 of the IPC. 2. Heard learned counsel for both sides and perused the record. 3. Attention has been drawn to the documents annexed on the basis of which it is submitted that the informant/wife of the petitioner, after spending 25 years of marital life with children, lodged the FIR against the petitioner raising certain vague allegations, on the basis of which the Fakirganj P.S. Case No.170/2019, under Sections 498(A)/294/325/307/34 of the IPC was registered and the accused/petitioner obtained pre-arrest bail in connection with the said case as on 06.09.2019. During the pendency of the said case, the informant/wife has filed the present FIR on similar accusation on 29.10.2019, on the allegation that the petitioner did not provide proper maintenance to the informant/wife and the children and also took some signatures on some documents for mutual divorce. No any specific case of cruelty is reflected in the FIR itself. 4. On the other hand, the petitioner herein has submitted that he is still willing to continue the marital live and in fact he has filed a case for restitution of the conjugal life vide T.S. (R) No.325/2019 and he never took any signature of the informant for divorce purpose, as alleged. 5. Having regard to the nature of accusation and the dispute between the parties, it transpires that custodial detention of the accused person is not warranted. Accordingly the petitioner is hereby allowed to go on pre-arrest bail of Rs.10,000/- with one surety of like amount, in the event of his arrest by the arresting officer in connection with Dhubri P.S. Case No.1896/2019, with further direction to the petitioner to appear before the I.O., within fifteen days from today and he will cooperate with investigation of the case.
