JUDGMENT Suresh Kumar Kait, J. - CRL.M.A. 14019/2020 (exemption) 1. Allowed, subject to all just exceptions. 2. Application is disposed of. CRL.M.C.1964/2020 3. Vide the present petition, petitioner seeks direction thereby for quashing of FIR No. 0554/2020 dated 23.07.2020, registered at PS - Model Town, Delhi and all other proceedings arising therefrom. 4. Notice issued. 5. Notice is accepted by learned APP for State and by learned counsel for respondent No.2 and with the consent of counsel for parties, the present petition is taken up for final disposal. 6. The present petition is filed on the ground that parties have settled their disputes and respondent No.2 has no objection if the present petition is allowed. 7. Petitioner and respondent No.2 have entered into an amicable settlement vide Compromise/Settlement Deed dated 01.08.2020. 8. Respondent No.2 is personally present in Court with her counsel and she has been identified by WSI Jyoti Mann/IO and submits that matter has been settled and she does not wish to prosecute the matter any further. 9. Taking into account the aforesaid facts, this Court is inclined to quash FIR as no useful purpose would be served in prosecuting petitioner any further. 10. For the reasons afore-recorded, FIR No. 0554/2020 dated 23.07.2020, registered at PS - Model Town, Delhi and consequent proceedings emanating therefrom are quashed. 11. Parties shall abide by the terms and conditions of the Compromise/Settlement Deed dated 01.08.2020 within five days failing which legal action shall be taken against the erring party. 12. It is agreed by the petitioner that three post-dated cheques issued by respondent No.2 along with an amount of Rs.50,000/- shall be returned to her by the petitioner. 13. Petitioner shall also take steps before the concerned authorities to get the video, uploaded on Youtube or any other social media, removed within one week from today failing which legal action shall be taken against the erring party. 14. The petition is, accordingly, allowed and disposed of. 15. The order be uploaded on the website forthwith.
