JUDGMENT : (Prayer: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of mandamus, directing the first respondent Bank to forthwith return all sums with interest being held by the respondents under Fixed Deposit Nos.0974401004437/1 (Certificate No.03/RDNC 0113330) 097441004281/2 (Certificate No.09-CDSC 494130) and Deposit Certificate No.09-CDSC 494129.) Earlier when the matter was called on 06.08.2020, the learned counsel for the petitioner represented that the papers have been returned to the petitioner long back. Hence, the learned counsel for the petitioner was directed to file a memo to that effect. Accordingly, a memo dated 06.08.2020 was filed by the learned counsel on record for the petitioner. It is also stated that the petitioner’s husband Mr.Ramachandran was informed of the case being listed on 25.08.2020 through WhatsApp on 05.08.2020. As the learned counsel on record for the petitioner had filed the memo, the Registry was directed to print the name of the petitioner. 2. Today, when the matter was taken up for hearing, the petitioner neither appeared in person nor through any other counsel. Hence, the Writ Petition is dismissed for non-prosecution. No costs.
