JUDGMENT : Harsimran Singh Sethi, J. 1. In the present contempt petition, the grievance of the petitioner is that despite undertaking before this Court more than once, fresh draft amounting to Rs. 11 lacs, to be deposited by the respondent-Simarnjit Singh, has not yet been handed over to the petitioner and hence he has intentionally and willfully disobeyed the orders passed by this Court, making himself liable to be proceeded against under Contempt of Courts Act, 1971. 2. Learned counsel for the petitioner submits that this Court on 28.01.2020 and thereafter, again on 04.03.2020 directed the respondent-husband Simarnjit Singh to issue fresh draft in favour of petitioner Pushpinder Kaur amounting to Rs. 11 lacs, but the said direction has not been complied with by the respondent so far. 3. Learned counsel for the petitioner argues that respondent-husband Simarnjit Singh is intentionally and willfully disobeying the orders dated 28.01.2020 and 04.03.2020 passed by this Court making him liable to be proceeded against under the Contempt of Courts Act, 1971. 4. Mr. Parvesh Chugh, Advocate, who has also joined the proceedings through video conference, keeping in view the service of advance copy of petition, accepts notice on behalf of respondent. After obtaining instructions from the respondent, learned counsel undertakes that petitioner will be handed over Rs. 11 lacs by RTGS or by draft by tomorrow i.e. 14.07.2020. 5. Learned counsel for the petitioner submits that keeping in view the undertaking recorded, petitioner does not press this contempt petition any further. 6. Disposed of as having been not pressed. 7. It is made clear that in case the above recorded undertaking is violated in any manner, respondent will be proceeded against under the Contempt of Courts Act, 1971 and a serious view of the violation of the undertaking recorded above will be taken. The proof of the payment will be placed on record of this file by the respondent through appropriate means immediately after the compliance of the undertaking by the respondent-husband.
