JUDGMENT : (Prayer: Civil Miscellaneous Appeal filed under Section 173 of the Motor Vehicles Act, 1988, against the judgment and decree dated 27.03.2012 made in MACTOP.No.298 of 2011 on the file of the III, Motor Accident Claims Tribunal, (Court of Small Causes), Chennai.) [This Appeal has been taken up for hearing through Video Conferencing] 1. This Appeal has been filed by the claimant seeking enhancement of compensation under the impugned award dated 27.03.2012 passed by the Motor Accident Claims Tribunal (III Judge, Court of Small Causes, Chennai) in MCOP.No.298 of 2011. 2. It is represented by the learned counsel for the Appellant that the sole Appellant died on 12.09.2013 and that he has taken steps by filing an application before this court in the year 2018 to bring on record the legal heir of the deceased Appellant. However, the Registry of this Court found that no such application has been filed by the learned counsel for the Appellant before this Court. 3. Since steps have not been taken to bring on record the legal representatives of the deceased sole Appellant, this Appeal shall stand dismissed as abated. No costs.
