JUDGMENT : 1. Heard Sri Kameshwar Singh, learned counsel for the petitioners, Sri Rahul Malviya, learned Standing Counsel appearing for the State respondent and perused the record. 2. By means of this writ petition, under Article 226 of the Constitution of India, the petitioners have challenged the order/notice dated 20.12.2019 issued by the respondent no.3 Additional Chief Officer, Zila Panchayat, Azamgarh on the ground that in spite of the petitioners having deposited the entire premium amount, the possession of the shop has not been given; even shop has not come to be constructed and yet petitioners petitioners are being forced to make further deposit, failing which the allotment shall stand cancelled. 3. We are of the considered opinion that the petitioners should first approach the competent authority in the matter against the notice dated 20.12.2019. 4. At this stage, learned counsel for the petitioners submits that he may be afforded one opportunity to approach the competent authority. 5. The writ petition is, accordingly, disposed of with a direction to the petitioner to submit his reply to the notice dated 20.12.2019 within a period of three weeks from today. In the event any such reply is submitted, the same shall be considered and disposed of by the competent authority, i.e. respondent no.2 by a reasoned and speaking order within a further period of four weeks before making any coercive measure pursuant to the order/notice dated 20.12.2019.
