Judgment Mr. Anupinder Singh Grewal, J. (Oral):- Heard through video conferencing. 2. The petitioner is seeking regular bail in FIR No.299 dated 27.08.2019, under Sections 302, 34, 452 and 506 IPC and Section 25 of the Arms Act, registered at Police Station Bawani Khera, District Bhiwani. 3. Learned counsel for the petitioner contends that the petitioner is only alleged to have instigated the co-accused namely Shamsher @ Sonu, who had fired gun shots on the deceased. There is also no motive which could be attributed to the petitioner. The petitioner is in custody for over 09 months and the conclusion of the trial is likely to take sometime. He is not involved in any other case. 4. Learned counsel for the complainant contends that it is alleged in the FIR that shots were fired by the co-accused Sonu from the house of the petitioner and the petitioner had instigated him to fire shots. 5. Learned State counsel states that the complainant and two eye witnesses have been examined. He further states that 26 other witnesses remain to be examined which include 02 other eye witnesses. 6. In view of the submissions of learned counsel for the petitioner, especially when the petitioner is attributed only a ‘lalkara’, he is in custody for over 09 months, the complainant and 02 eye witnesses have been examined, Covid 19 pandemic and the conclusion of the trial is likely to take some time, I deem it a fit case to grant the concession of regular bail to the petitioner. 7. Therefore, without expressing any opinion on the merits of the case, the petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing requisite bonds to the satisfaction of the trial Court/Duty Magistrate concerned. 8. However, the petitioner shall not make any effort to contact or pressurize any of the witnesses and he shall report to the Police Station, Bawani Khera, District Bhiwani on every Monday till the conclusion of the trial.
