JUDGMENT S. Muralidhar, J. - This is a petition seeking parole for a period of eight weeks, which reqeust came to be declined by an order dated 11 th May, 2020 of the Deputy Commissioner-cum-District Magistrate, Moga. 2. The Petitioner was convicted by the judgment dated 8 th July, 2019 of the Special Court, Moga, under Section 22/61/85 of NDPS Act for being found in possession of 300 grams of intoxicated powder. 3. The application for release on parole for 8 weeks was rejected inter alia on the ground that if released on parole "there is danger of state security/maintenance of public order because this prisoner can do the business of Narcotic after running during parole". 4. In response to the pointed query of the Court, learned counsel for the Respondent confirms that there is no previous instance of the Petitioner having been involved in any offence, much less an offence under the NDPS Act. 5. The Petitioner is a 21 year-old woman. The Court is unable to appreciate why the local authorities cannot ensure that she complies with the conditions of parole which, in any event, is for a period of 8 weeks. 6. In such circumstances, while setting aside the order dated 11 th May, 2020 passed by the Deputy Commissioner-cum-District Magistrate, Moga, the Court directs the release of the Petitioner for a period of 8 weeks on parole, from the date of her release, subject to her furnishing security/personal bond in the sum of Rs. 20,000/-, with one surety of the like amount to the satisfaction of Superintendent of the concerned jail and subject to further condition that she will promptly surrender on the expiry of the parole period. 7. The petition is disposed of in the above terms. Pending application, if any, is disposed of.
