Learned Additional Advocate General, on the basis of records, submits that the department had not received copy of online application from the petitioner to forward the same to the H.P. Public Service Commission. Learned counsel for the petitioner submits that the application, by the petitioner was submitted directly to the Principal, Lal Bahadur Shastri Medical College, Ner Chowk, District Mandi, and he has not submitted online application to the H.P. Public Service Commission, for the reason that he was inservice candidate. 3. Learned counsel for the petitioner submits that the petitioner had not to submit online application, but had to submit application through proper channel, that is, through Principal, Lal Bahadur Shastri Medical College, Ner Chowk, District Mandi. 4. It is case of the petitioner that he has applied in response to the advertisement No.25/2019, dated 27 th December, 2019, issued by the H.P. Public Service Commission. In the said advertisement, it has also been notified that how the applications are to be submitted by the candidates desirous for appointment against the post advertised, which reads as under:- 'a) Desirous/eligible candidates must have to apply online through official website of the Commission http://www.hppsc.hp.gov.in/hppsc. Applications received through any other mode would not be accepted and summarily rejected. b) The candidates, who wish to apply for more than one post, should apply separately for each post and will have to pay the requisite examination fees for each post in the prescribed manner. c) After submitting the Online Recruitment Application(s) (ORA), the candidates are required to take a printout of the finally submitted Online Recruitment Application and submit the same along with requisite attested documents/ certificates in support of their eligibility for the concerned post(s) on the day of screening test and in other cases where direct Personality Test will be held, 10 days time will be given to submit requisite documents failing which his/her candidature shall stand finally rejected as per essential qualification(s) for the concerned posts(s). No extra time will be given for submission of any documents. d) In case the candidate has applied against more than one item i.e. post published in the advertisement, the candidate is required to submit separate copies of requisite attested documents/certificates along with the printout of the Online Recruitment Application of each post on the day of Screening Test for the respective posts.' 5. d) In case the candidate has applied against more than one item i.e. post published in the advertisement, the candidate is required to submit separate copies of requisite attested documents/certificates along with the printout of the Online Recruitment Application of each post on the day of Screening Test for the respective posts.' 5. Faced with the aforesaid provision, learned counsel for the petitioner seeks liberty to withdraw the petition to file a fresh comprehensive petition with better particulars on the same cause of action. 6. Prayer of the learned counsel for the petitioner is accepted and petition is dismissed as withdrawn with liberty, as prayed for. The petition stands disposed of accordingly, so also pending application(s), if any.
