JUDGMENT G. Sri Devi, J. - This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973 (Cr.P.C.), is filed by the petitioner/accused, for grant of anticipatory bail in Crime No.238 of 2019 of P.S. Kosgi, Narayanapet District, registered for the offences punishable under Sections 366 and 376(2)(i)(n) of the Indian Penal Code and Section 5(1) read with Section 6 of the Protection of Children from Sexual Offences Act, 2012. 2. Heard the learned counsel for the petitioner/accused, the learned Additional Public Prosecutor representing the respondent-State and perused the record. 3. In the FIR, it is inter alia stated that the petitioner/accused developed acquaintance with the victim, who is a minor. About two months prior to 03.12.2019, when she was alone in her house, the petitioner went to her house and participated in sexual intercourse with her. On subsequent days also he participated in sexual intercourse with her for several times and that on 29.10.2019, when she was in her college, he forcibly took her away to Hyderabad by telling gullible words, kept her in his friend's room and again participated in sexual intercourse with her and later dropped her in Tandur. 4. Learned counsel for the petitioner/accused would submit that the petitioner/accused has not committed any such offence. The victim herself sent a marriage proposal to him, but he refused to marry her and so to harass him, she created this case against him. The petitioner/accused is a law-abiding citizen and working as a Government Teacher in Narayanapet. It is further submitted that the petitioner/accused is an innocent person and to extract money by blackmailing him, the de facto complainant foisted this case. It is further submitted that the entire investigation is over and charge sheet is yet to be filed. Hence, he prayed to grant anticipatory bail to the petitioner/accused. 5. Learned Additional Public Prosecutor representing the respondent-State opposed to grant anticipatory bail to the petitioner/accused. 6. As seen from the contents of the F.I.R., there are specific allegations against the petitioner/accused that he has developed physical relationship with the victim and he has forcibly taken her to Hyderabad and continued physical relationship and fled away from the place. 7. Having regard to the facts and circumstances of the case, nature and gravity of the offence, this Court is not inclined to grant anticipatory bail to the petitioner/accused. 8. The Criminal Petition is, accordingly, dismissed. 9.
