JUDGMENT Ritu Bahri, J. - CRM-17336-2020 1. For the reasons mentioned in the application, same is allowed and Sections 489-A and 489-D IPC are ordered to be added in the prayer clause as well as main petition. 2. Office to incorporate necessary amendment in the prayer clause as well as main petition. CRM-20208-2020 Annexure A-l is taken on record. Misc. application stands allowed accordingly. CRM-M-16126-2020 3. This petition under Section 439 Cr.P.C. is for grant of regular bail to the petitioner in case FIR No. 193 dated 08.06.2020, under Sections 420/489-B IPC, registered at Police Station, Division No.8, District Ludhiana. 4. Learned counsel for the petitioner refers to the challan (AnnexureA-1) and contends that recovery of ATM machine/printer and notes was alleged to have been effected on 06.05.2020. However, the notes and the printers were taken into police custody by HC Major Singh on 17.06.2020. Delay in taking the notes into custody has not been explained in the challan. Learned counsel further states that printers was sent to the CFSL, Chandigarh and FSL, Mohali, which was returned by both the Laboratories stating that they do not have any facility to examine the same. 5. The petitioner is in custody since 09.06.2020. 6. Learned State counsel is not disputing the said fact. He states that after presentation of challan, 13 witnesses are to be examined before the trial Court. 7. Heard. 8. Keeping in view that the period of incarceration of the petitioner and the fact that the trial will take some time for its conclusion, this Court feels that no purpose will be served by detaining the petitioner any longer. Accordingly, this petition is allowed and the petitioner is ordered to be released on regular bail on his furnishing of bail/surety bonds to the satisfaction of the trial Court/Chief Judicial Magistrate/Duty Magistrate, Ludhiana. 9. The opinion given in the above order shall not have any effect on the decision of the trial on merits.
