ORDER : Heard the learned counsel for the petitioner and the learned Additional Government Advocate. 2. The petitioner is the daughter of one Shyam @ Raju Reddy @ Raju @ Prabhakar Reddy. It is submitted that the petitioner is on the verge of getting married and that parole is sought for the convict who is said to be the father of the petitioner. It is submitted that the earlier writ petition No.8165/2020 was filed but the same was not accompanied by the Wedding Invitation. The same was withdrawn and now the instant petition is filed. 3. The learned counsel for the petitioner would submit that the petitioner had in fact been released on parole by this Court 05-02-2020 to attend to his mother who was terminally ill with Tuberculosis. The copy of the order passed in writ petition No.528/2019 is produced as Annexure-C. The learned counsel for the petitioner makes reference to Annexure-A, the report of the Jail authorities more particularly, the Chief Superintendent of Prisons, Belagavi wherein the conduct of the prisoner is noted to be ‘satisfactory’ in this regard. The learned counsel for the petitioner submits that the petitioner may be released on similar conditions as imposed by this Court writ petition No.528/2019. That apart, the petitioner also places reliance on the Certificate issued by the Primary Health Centre wherein the condition of the mother is said to be serious. 4. The learned Additional Government Advocate would vehemently oppose the grant of parole and would submit that the conduct of the convict is not satisfactory. The learned Additional Government Advocate is unable to place any material to controvert the contents of Annexure-A. It is also not in dispute that pursuant to the order of this Court dated 05-02-2020 rendered in writ petition No.528/2020, the convict has in compliance with the order reported back to jail authorities well within the time stipulated by this Court. Keeping in consideration the above factors, this Court is of the opinion that the petitioner has made out a case for grant of parole. Accordingly, the petitioner shall be released on parole for a period of 10 days, excluding travel days commencing from tomorrow, that is 19-08-2020. Keeping in consideration the above factors, this Court is of the opinion that the petitioner has made out a case for grant of parole. Accordingly, the petitioner shall be released on parole for a period of 10 days, excluding travel days commencing from tomorrow, that is 19-08-2020. Hence the following: ORDER : (a) Petitioner/convict No.3343 lodged in Hindalga Jail, Belegavi shall be released on parole on 19-08-2020 subject to he executing a personal bond for Rs.50,000/(Rupees Fifty Thousand) with two sureties for the likesum to the satisfaction of the prison authorities. (b) Petitioner’s father/the convict shall report back to the jail authorities on or before 02-09-2020 at 4.00 p.m. (c) The convict shall report to Tirumalashettyhalli Police Station every day from 19-08-2020 to 02-09-2020. Petition is disposed off accordingly. Office to communicate this order to the Jail Authorities.
