JUDGMENT Amol Rattan Singh, J. - All cases listed today have been taken up for hearing by way of video conferencing because of the situation existing due to the COVID-19 pandemic. 2. This petition has been filed under the provisions of Section 439 of the Cr.P.C., seeking 'regular bail' for the petitioner in case FIR no. 137, dated 22.05.2019, registered at Police Station Dhrui, District Sangur, for the alleged commission of offences punishable under Sections 365 and 342 read with Section 34 of the IPC. 3. Learned counsel for the petitioner submits that even as per the FIR, the active role is actually attributed to two persons, i.e. Raju Khalsa and @ Pal Singh and further, that the petitioner has been in custody for more than one year and three months now, with even the charges not framed by the trial court so far. 4. Learned State counsel while otherwise opposing the bail application, on the ground that there were many injuries on the body of the deceased and therefore the petitioner does not deserve the concession of bail, could not deny the factual position above, as regards the custody of the petitioner or the fact that the charges have not been framed so far. 5. That being so, without making any comment on the actual merits of the case for or against the petitioner, the petition is allowed. The petitioner shall be admitted to bail upon his furnishing adequate bail bonds and surety bonds to the satisfaction of the learned trial court/Chief Judicial Magistrate/Duty Magistrate, concerned.
