JUDGMENT Tejinder Singh Dhindsa, J. - Matter has been taken up through Video Conferencing via Webex facility in the light of the Pandemic Covid-19 situation and as per instructions. 2. Petitioner seeks benefit of regular bail pending trial in case FIR No.49, dated 16.08.2019, under Sections 457/376(2)/312/313/120-B IPC and Section 6 of the POCSO Act, 2012, registered at Police Station Thulliwal, District Barnala. 3. Counsel for the parties have been heard. 4. FIR came to be registered on the statement of Baldev Singh. Allegations are that daughter of the complainant aged, 16 years has been sexually assaulted by one Yograj on the false pretext of marriage. 5. Apparently, the victim in her statement recorded under Section 164 Cr.P.C. has stated that at one point of time she had been impregnated and thereafter, the aunt, sister-in-law as also brother of Yograj had furnished to her a pregnancy termination kit. 6. Present petitioner is the brother of main accused, Yograj Singh and it is on the strength of the statement of victim recorded under Section 164 Cr.P.C. that the present petitioner has been implicated. 7. Concededly, petitioner has been booked by citing offence under Sections 312/313/120-B IPC, which were added subsequently. 8. Petitioner was arrested on 13.03.2020. 9. Investigation in the case is complete and challan has been filed. 10. Charges are yet to be framed. Trial would take time to conclude particularly keeping in view the current Covid-19 situation. 11. Co-accused, Manjeet Kaur @ Kali as also Veerpal Kaur @ Gukar and against whom there were similar allegations have been granted benefit of bail. 12. In an overview of the matter as also on the ground of parity itself, petitioner is held entitled to the benefit of bail. 13. Petitioner be enlarged on bail subject to his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate concerned. 14. Disposed of.
