ORDER 1. Leave granted. 2. The appellant has been implicated in FIR No 160 dated 24 June 2015 lodged at Police Station Kapurthala City with reference to the provisions of Sections 498A and 406 of the Indian Penal Code I860 [1] . An application for anticipatory bail was rejected by the High Court. [1] "IPC" 3. On 2 May 2019, this Court, while issuing notice, granted a stay of arrest. 4. In pursuance of the notice issued by this Court, both the State of Punjab and the complainant have entered appearance through counsel. 5. Having regard to the facts and circumstances of the case, we are of the view that the appellant should be granted the benefit of the provisions of Section 438 of the Code of Criminal Procedure 1973. Hence, we direct that in the event of the arrest of the appellant, he shall be released on bail, subject to such terms and conditions as may be imposed by the competent Court. In the event that any investigation is under way, the appellant shall cooperate with the investigation. 6. The appeal is accordingly disposed of.
