JUDGMENT 1. Md. Mozamil Haque has preferred this application for bail under Section 439 of the Code of Criminal Procedure, 1973 in Boko P.S. Case No.1295/2019 under sections 294/353/379/34 I.P.C. 2. Learned counsel for the petitioner at the outset has pointed out that co- accused similarly placed, Md. Mun Ali, has been allowed bail in the same FIR vide order dated 5 th February, 2020 of this Court while dealing with Bail Application No.355 of 2020. 3. Learned counsel for the prosecution does not dispute the fact. 4. Order dated 5.2.2020 rendered in Bail Application No.355 of 2020 reads as under : 'By filing this petition under Section 439 of the CrPC, petitioner Mun Ali who is in custody since 25.12.2019, has prayed for releasing him on bail in connection with Boko P.S. Case No.1295/2019 (corresponding to G.R. No.515(K)/2019), under Section 294/353/379/34 of the IPC. Heard the learned counsel for the parties and perused the case record. According to the allegation made in the FIR, the accused petitioner led the local people to resist the police personnel while they were discharging their duties and tried to apprehend the accused of theft case and his earlier bail application was rejected. Considering the nature of accusation, it appears that the investigation might have completed by this time and release of the accused will not hamper the investigation of the case. Accordingly the accused/petitioner named above is allowed to go on bail in connection with the Boko P.S. Case No.1295/2019, on furnishing bail bond of Rs.20,000/- with one surety of the like amount to the satisfaction of the learned Judicial Magistrate 1st Class, Boko. The application stands disposed of.' 5. The application for bail of petitioner Md. Mozamil Haque is allowed in terms of the above extracted order.
