JUDGMENT 1. By this application, filed under Section 438 of the Cr.PC , the accused-petitioner, namely, Mozibur Rahman has prayed for pre-arrest bail apprehending arrest in connection with Dhubri P.S. Case No. 1895/2019 under Section 120(B)/376/325 IPC R/W Section 6 of POCSO Act. 2. Heard Mr. M. Ahmed, learned counsel for the petitioner as well as Mr. T.K. Misra, learned Additional Public Prosecutor, appearing for the State of Assam. 3. Perused the FIR and the documents annexed with the petition including the case diary produced today. 4. The allegation made in the FIR lodged by the father of the alleged victim was that the accused/petitioner having established intimacy with his daughter had physical relation and when there was discussion about marriage between them, the accused/petitioner avoided on various pretext and the FIR was lodged. 5. Case diary does not transpire any incriminating material justifying necessity of custodial interrogation of the present petitioner and as such, the prayer for pre-arrest bail deserves to be allowed. Accordingly, it is provided that in the event of arrest of the petitioner, he shall be released on furnishing a bail bond of Rs. 20,000/- with one suitable surety of the like amount to the satisfaction of the arresting authority. The prearrest bail is subject to the following conditions. 1. The petitioner shall appear before the Investigating Officer within 15 days and co- operate with the investigation. 2. The petitioner shall not directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or to any police officer. 6. Bail application is disposed of. Return the case diary.
