JUDGMENT : (Prayer: Petition filed under Article 226 of the Constitution of India seeking a Writ of Mandamus, to forebear the respondents from in any manner interfering with the peaceful possession and enjoyment of the petitioner in respect of the lands in Survey No.41/2A of an extent of 0.045.5 ares and in Survey No.44/4 of an extent of 0.28.5 ares in Pattamudaiyan Village, Avudaiyarkoil Taluk, Pudukottai District.) 1. This Writ Petition has been filed for a Mandamus to forebear the respondents from in any manner interfering with the peaceful possession and enjoyment of the petitioner's property situated in Survey No.41/2A measuring to an extent of 0.045.5 ares and in Survey No.44/4 measuring to an extent of 0.28.5 ares in Pattamudaiyan Village, Avudaiyarkoil Taluk, Pudukottai District. 2. By consent of both parties, this Writ Petition has been taken up for final disposal at the stage of admission itself. 3. It is the case of the petitioner that he is the absolute owner of the property ever since 1974, having purchased the same under a registered sale deed, dated 06.11.1974. According to the petitioner, ever since his purchase, he is in absolute possession and enjoyment of the property. However, all of a sudden, of late, it is the contention of the petitioner that the respondents have made an attempt to interfere with the peaceful possession and enjoyment of the property by the petitioner. 4. Mr.C.Ramar, learned Additional Government Pleader, who takes notice on behalf of the respondents, on instructions, would submit that they are not interfering with the peaceful possession and enjoyment of the petitioner's property. He would further submit that the petitioner is having dispute with the neighbouring land owners. 5. Recording the submissions made by the learned Additional Government Pleader appearing for the respondents, nothing survives for adjudicating the matter, as the respondents have made clear before this Court that they are not interfering with the peaceful possession and enjoyment of the petitioner's property. Hence, this Writ Petition stands disposed of. However, there is no order as to costs. Consequently, connected miscellaneous petition is closed.
