JUDGMENT Sudhir Mittal, J. - The petitioner seeks grant of regular bail in case FIR No. 122 dated 18.03.2020 registered at Police Station Islamabad, District Amritsar City, under Sections 21 & 29 of NDPS Act, 1985. 2. Learned counsel for the petitioner submits that the petitioner has been in custody for more than 05 months. His wife who is a co-accused in this case from whom 500 grams heroin was recovered, has been granted regular bail by this Court vide order dated 25.09.2020 passed in CRM-M20738-2020 (Annexure P-1). Thus, the petitioner also deserves to be granted the same concession. 3. Custody certificate dated 03.11.2020 has been produced in Court. The same is taken on record. According to this certificate, the petitioner has undergone actual custody of 05 months and 13 days and there is no criminal case pending against him. 4. Learned State counsel submits that 280 grams of heroin was recovered from the house of the petitioner which is commercial quantity. He, however, does not dispute that wife of the petitioner is a co-accused in this case and has been granted regular bail by this Court vide order dated 25.09.2020 passed in CRM-M-20738-2020 (Annexure P-1). 5. Keeping in view the principle of parity, I deem it appropriate to grant regular bail to the petitioner also. 6. Accordingly, the petition is allowed and the petitioner is directed to be released on regular bail on his furnishing bail and surety bonds to the satisfaction of the trial Court/Duty Magistrate concerned.
