JUDGMENT 1. Heard Mr. R. Ali, learned counsel for the petitioner and Mr. H.K. Sharma, learned Addl. Public Prosecutor, Assam for the State respondent. 2. By this application filed under Section 438 Cr.P.C. , the petitioner, namely, Tofidul Islam @ Kechu has prayed for pre-arrest bail in connection with Lakhipur P.S. Case No. 16/2020 under Sections 376(I)/417/294/506/109 IPC read with Section 6 of the POCSO Act. 3. Perused the case diary produced today. 4. The allegation against the petitioner is of non-consensual sex having inducing the victim. The case diary reflects incriminating materials against the petitioner. 5. Having considered the materials available in the case diary and the nature of accusation, this does not appear to be fit case for extending the benefit of the pre-arrest bail. Accordingly, the prayer for prearrest bail is rejected. Return the case diary.
