JUDGMENT : (Prayer : To issue a Writ or order or direction in the nature of Writ of Mandamus, to direct the respondents no.1 and 2 to accept the examination fees to the arrear papers of the petitioner and to permit the petitioner to write the his examination to the course of Diploma in Civil Engineering by considering the petitioners representation dt 04.04.2020 and 03.07.2020 sent by mail to the official website of the 1st respondent.) The Writ Petition has been filed for a direction to R1 and R2 to accept the examination fees to the arrear papers of the petitioner and to permit the petitioner to write his examination to the course of Diploma in Civil Engineering by considering the petitioner's representation dated 04.04.2020 & 03.07.2020, sent by mail to the Official Website of the 1st respondent. 2. Mr.K.P.Krishnadoss, learned Special Government Pleaders seeks time to ascertain from the respondents about the possibility of permitting the petitioner to write his arrears examinations, as, according to him, it would be very difficult for the respondents to prepare question papers for one person and conduct examinations. He further submitted that if the request of the petitioner is entertained, there is every possibility of receiving more such requests by the respondents. 3. It is seen that the petitioner did not pay the examination fee on or before 10.03.2020, which was fixed as a late date for payment, on account of the reason that he waited for his revaluation result at that time and since he did not come out successful in the revaluation, he immediately approached the respondents for payment of necessary fee for writing arrear examinations. Hence, the non payment of examination fee in time is neither wanton nor wilfil on the part of the petitioner and therefore, the Government may provide one more “last opportunity” not only to the petitioner, but also to similarly placed persons like the petitioner to appear for the examination, due to Covid situation, clearly stating that if they fail to avail the said opportunity, it will be a “lost opportunity”. The grant of one more opportunity to write examinations is better than “Covid Pass”. List this matter on 06.11.2020.
