JUDGMENT Lisa Gill, J. - This matter is being taken up for hearing through video conferencing due to outbreak of the pandemic, COVID-19. 2. Petitioner seeks concession of bail pending trial in FIR No. 86 dated 09.03.2012, under Section 376, 506, 120-B IPC, Police Station Baldev Nagar, District Ambala. 3. As per allegations in the FIR, the complainant's daughter was allured by the petitioner with a promise to marry and it is alleged that the petitioner committed rape upon the complainant's daughter for three (03) years on this pretext. 4. Learned counsel for the petitioner argues that the alleged victim was 27 years old at the time of the alleged incident and the relationship, if any, between the petitioner and the victim was consensual in nature and there is no question of any element of force involved therein. It is submitted that there are serious discrepancies in the deposition of the victim, who has deposed as PW-1. It is thus prayed that this petition be allowed. 5. I have heard learned counsel for the parties and have gone through the file with their assistance. 6. It is to be noted that this FIR was registered on 09.03.2012. The petitioner's application for anticipatory bail was dismissed by this Court on 03.09.2012 in CRM-M-26867 of 2012. It is to be noticed that the petitioner absconded and he was declared a proclaimed offender on 18.09.2012. The co-accused, are informed to have been acquitted 12.12.2013. Petitioner was ultimately arrested on 21.05.2020 and it is apparent that trial is under way. Statements of the victim and the complainant stand recorded on 07.10.2020 and 14.10.2020, respectively. 7. Keeping in view the conduct of the petitioner, I do not find any ground whatsoever to extend the concession of bail pending trial to the petitioner, at this stage. 8. Petition is accordingly dismissed. However, learned trial Court, shall make efforts to conclude the trial expeditiously.
