JUDGMENT Sudip Ahluwalia, J. - The present petition has been filed under Section 439 of the Cr.P.C. by the petitioner, seeking regular bail in case FIR No.189 dated 13.06.2020, under Sections 302, 307 and 34 of the IPC and Section 25 of the Arms Act (Section 212 and 120-B of the IPC added in challan), registered at Police Station IMT Rohtak, District Rohtak. 2. The petitioner was arrested in connection with this case on 15.06.2020. He was not named in the original FIR, although he has a similar name with another FIR named accused Vicky son of Satish @ Mira. 3. Involvement of the petitioner in the present case is sought to be made out only through the disclosure statement of co-accused Manbir. 4. After completion of investigation, challan against the petitioner has already been submitted. 5. The petitioner is stated to be involved in four other FIR cases, the details of which have been given in Para No.8 of the petition. But, it is submitted today that in respect of FIR No.309 dated 07.12.2007, under Sections 323, 307, 452 ad 506 of the IPC, registered at Police Station Sampla and FIR No.347 dated 18.08.2010, under Sections 302 and 34 of the IPC and Section 25 of the Arms Act, registered at Police Station Sampla, as mentioned therein, he has already been acquitted, while he is on bail in the other matters. 6. Out of 22 witnesses cited in the challan, only one witness has been examined so far. 7. As such, without commenting any further on the merits of the present case as a whole and in view of the detention undergone by the petitioner, as also the fact that the trial is likely to take its own substantial time, particularly on account of the ongoing Covid-19 pandemic, the prayer of the petitioner for regular bail is allowed and he is ordered to be released on bail, subject to appropriate terms and conditions to the satisfaction of the Ld.Trial Court/Duty Magistrate, concerned. 8. Disposed off.
