JUDGMENT : SANDEEP MEHTA, J. 1. The instant appeal under Section 374(2) Cr.P.C. has been preferred by the appellants herein being aggrieved of the judgment dated 19.01.1993 passed by the learned Additional District and Sessions Judge, Raisinghnagar in Sessions Case No. 50/92, whereby they were convicted and sentenced as below:- Offence Sentences Fine Fine Default sentences Section 304 Part II IPC read with Section 34 IPC 4 Years' R.I. Kharlia, learned senior counsel assisted by Shri Digvijay Singh representing the appellants vehemently and fervently contended that the conviction of the appellants as recorded by the trial court for the offence under Section 304 Part II IPC is absolutely unjustified. He drew the Court's attention to the findings recorded by the trial court in the impugned judgment where, it has been conclusively held that the deceased Bhajanlal trespassed into the house of the appellants with the intention of indulging in some vile act with Rampyari and at that point of time, acting under grave and sudden provocation, the accused persons beat him up. He submits that as per the evidence of medical expert Dr. Charanjeet Singh (PW.3), a total of 52 injuries were noticed on the body of the deceased Bhajanlal but apart from four fractures on non-vital parts of the body, all the other injuries were simple superficial in nature. Thus, as per Shri Kharlia, the conviction of the appellants deserve to be altered to one under Section 335 or 325 IPC. He urges that three of the five convicted accused were extended the benefit of probation. The accused appellants have remained in custody for a period well in excess of two years and thus, the ends of justice would be subserved by reducing the sentence awarded to the appellants by the trial court to the period already undergone by them. With these submissions, Shri Kharlia, learned senior counsel prayed for acceptance of the appeal by toning down the offence alleged against the accused and reducing the sentence awarded to them. 3. Nonetheless, he too is not in a position to dispute the fact that the trial court, after thorough appreciation of the evidence available on record, came to a concrete conclusion that the deceased Bhajanlal trespassed into the house of the accused intending to indulge in some immoral act with Rampyari W/o Shri Krishan. He had made 2-3 previous attempts of similar nature for which Panchayats had been convened and the deceased and his brothers had sought atonement. On the day of occurrence, Bhajanlal after consuming liquor entered into the house of the accused whereupon, Rampyari who was washing utensils raised a hue and cry. Being enraged, the accused-appellants and the co-convict, thrashed Bhajanlal with the intention of teaching him a lesson. The findings so recorded by the trial court at para Nos. On the day of occurrence, Bhajanlal after consuming liquor entered into the house of the accused whereupon, Rampyari who was washing utensils raised a hue and cry. Being enraged, the accused-appellants and the co-convict, thrashed Bhajanlal with the intention of teaching him a lesson. These conclusions of the trial court, which in my opinion are duly fortified by the evidence available on record, clearly establish that the deceased Bhajanlal was a man of foul character. He had made 2-3 earlier attempts to enter the house of the accused with the intention of establishing physical relations with Rampyari for which he was chastised after calling Panchayats and sought forgiveness. On the fateful day as well, it was the deceased who after consuming liquor entered into the house of the accused persons with the same evil intention of trying to force himself upon Rampyari. Thus, his act amounted to rank-trespass with the intention to commit a cognizable offence. The allegation of the prosecution that the accused dragged Bhajanlal into their house is per se unacceptable and was rightly discarded by the trial court. No sooner, the deceased entered into the house, Rampyari raised a hue and cry and the accused persons, being the male members of the family were rightfully enraged and were justified in taking to arms for the purpose of chastising Bhajanlal. 5. In view of the fact that the deceased had trespassed into the house of the accused-appellants with the intention of outraging modesty of a woman family member, the accused definitely had a right of private defence. Nonetheless considering the fact that excessive number of injuries were caused to deceased Bhajanlal i.e., 52 in number, manifestly they exceeded this right beyond proportions. However, law is well settled that once the Court comes to a conclusion that the accused exceeded the right of private defence, they cannot be convicted with the aid of Section 34 of the IPC because then they would be exercising a right and cannot be clothed with the intention to commit an offence. Therefore, the accused would have to be held responsible for their individual acts and particular injuries caused to the deceased. Manifestly, there is no evidence of the prosecution in this regard. As per the medical evidence, out of 52 injuries noticed on the body of the deceased, four were grievous in nature. Therefore, the appellants can at best be held guilty for the offence under Section 325 IPC. Thus, the conviction of the appellants as recorded by the trial court for the charge under Section 304 Part II IPC read with Section 34 IPC is toned down to Section 325 IPC. 6. A perusal of the record indicates that the accused persons were arrested in February, 1992 and remained in custody till March, 1994 when their sentences were suspended by this Court in this appeal. Thus, the appellants have suffered substantive imprisonment for a period in excess of two years. The sentence of more than two years already suffered by the appellants would suffice in my opinion to subserve the ends of justice. In addition, the appellants are sentenced to fine of Rs. 2000/- each which they shall deposit with the trial court within a period of two months from today, failing which they shall serve default imprisonment of two months each. The appeal is partly allowed in these terms. The accused-appellants are on bail. They need not surrender. Their bail bonds are discharged. 7. Record be returned to the trial court forthwith.
