JUDGMENT Nataraj Rangaswamy, J. - This appeal is filed by the insurer challenging the liability cast upon it to pay compensation awarded by the Tribunal in MVC No. 15/2008. 2. The Tribunal in terms of its Judgment and Award dated 03.08.2012 had directed the insurer to pay the compensation of a sum of Rs. 4,12,200/- to the claimant towards the injuries that he had sustained in an accident on 05.09.2007 which involved a motor cycle bearing Registration No. KA-20-L-8141 and bus bearing Registration No. KA-19-AD-5977. The Tribunal had directed the insurer to pay the compensation to the claimants. 3. The insurer in this appeal contended that the bus bearing Registration No. KA-19-AD-5977 had deviated from the route which was not permitted and therefore the insured had violated the terms of the permit and therefore he was not liable to pay the compensation. 4. This issue is now fully settled by the Full Bench of this Court in the case of Yellavva and another v/s New India Assurance Co. Ltd., (2020) 2 KCCR 1405 (FB) and therefore the question of interfering with the judgment and award of the Tribunal would not arise. Hence this appeal lacks merit and the same is dismissed. Any amount in deposit before this Court is directed to be transmitted to the Tribunal forthwith for necessary orders.
